Terms of Service
The terms on which Ecommerce Transhipment Solution Ltd provides the 1stsend service.
1. About these terms
These terms apply between Ecommerce Transhipment Solution Ltd, a company registered in England and Wales (company number 08586595), registered office Cici House, 58 Derby Street, Manchester, M8 8HF, United Kingdom ("we", "us") and the business that signs up to use 1stsend ("you"). The service is provided to businesses only.
2. The service
1stsend is a shipping and fulfilment service for Amazon sellers. It imports your Amazon orders, generates shipping labels, stores, picks, packs and dispatches your goods, and sends shipment confirmation and tracking back to Amazon, as described on our Features page.
3. Your account
You are responsible for the accuracy of the information you give us, for keeping your sign-in details confidential and for all activity under your account. Tell us promptly if you suspect unauthorised use.
4. Amazon authorisation and your obligations
- You authorise us to access your Amazon seller account through the Amazon Selling Partner API for the purposes described in our Privacy Policy. You may revoke this authorisation at any time in Amazon Seller Central.
- You remain responsible for your Amazon seller account and for complying with Amazon's policies.
- You must make sure that the goods you send us are accurately described, lawful to store and ship, and correctly packaged where you pack them yourself.
5. Fees and payment
Our fees are set out on our Pricing page or in a written quote we have given you. Fees are in GBP and exclude VAT, which is charged at the prevailing UK rate.
6. Data protection
When we process Amazon buyer personal data on your behalf, we act as your processor and process it only on your instructions and as described in our Privacy Policy, including deleting Amazon buyer personal information within 30 days of order delivery.
7. Availability
We aim to keep 1stsend available at all times but may need to suspend it for maintenance or for reasons outside our control. We will give notice of planned maintenance where we reasonably can.
8. Liability
Nothing in these terms limits liability that cannot be limited by law. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue or business. Our total liability in any 12-month period is limited to the fees you paid us in that period.
9. Term and termination
You may cancel as set out on our Pricing page. Either party may terminate immediately if the other materially breaches these terms and does not remedy the breach within 30 days of notice. When the service ends we stop accessing your Amazon account, and Amazon buyer personal information is deleted within 30 days.
10. Changes
We may update these terms from time to time. We will notify you by email of material changes before they take effect.
11. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
